Fire Compliance in NZ: What Every Building Owner Must Know

What Is Fire Compliance in New Zealand?

If you own or manage a commercial building in New Zealand, fire compliance isn’t optional, it’s a legal requirement. Fire protection systems, evacuation procedures, and maintenance records are all part of ensuring your building is safe for occupants and compliant with the New Zealand Building Code (NZBC) and the Building Act 2004.

This guide explains what fire compliance involves, what your obligations are, and how you can stay ahead of audits and inspections.

Key Fire Compliance Requirements

1. Specified Systems

If your building has systems such as fire alarms, sprinklers, emergency lighting, or smoke control systems, they are classified as "specified systems" under the Building Act.

You are responsible for:

  • Ensuring they are installed and maintained correctly

  • Scheduling regular inspections and servicing

  • Keeping records of all maintenance and testing

2. Building Warrant of Fitness (BWoF)

Every year, a BWoF must be issued for buildings with specified systems. It confirms that:

  • All systems have been inspected and maintained

  • You’ve received Form 12A certificates from Independent Qualified Persons (IQPs)

  • You’re keeping up-to-date records in the onsite Compliance Schedule logbook

Important: Missing a BWoF deadline or failing to maintain systems can result in fines of up to $20,000.

3. Evacuation Schemes

If your building meets certain criteria (e.g. sleeps 10 or more people, houses vulnerable occupants, or holds 100 or more visitors), you must have an approved evacuation scheme through Fire and Emergency NZ (FENZ).

Evacuation training and regular trial evacuations are also required.

Common Fire Compliance Mistakes (and How to Avoid Them)

  • Missed inspection schedules: Use a digital or printed calendar with service reminders

  • Incomplete or outdated documentation: Your compliance folder should always be current and easily accessible

  • Non-IQP maintenance providers: Only certified IQPs can issue valid Form 12As

  • Blocked exits or damaged signage: These are frequently overlooked but are major compliance breaches
